Nicholas Le Poidevin, Q.C.’s practice is both contentious and non-contentious and the focus is on trusts, wills and estates, together with the associated conflict of laws and professional negligence.
He has appeared in the Supreme Court of the U.K. and in the Privy Council. He also appears in courts offshore, particularly those of Bermuda and the B.V.I. Recent cases are:
· Meritus v. Butterfield [2017] SC (Bda) 82 Civ in Bermuda (rights of an outgoing trustee);
· Marley v. Rawlings [2015] A.C. 157 in the Supreme Court (switched wills); and
· Crociani v. Crociani (2014) 17 I.T.E.L.R. 624 in the Privy Council, on appeal from Jersey (jurisdiction clauses in trusts).
He regularly advises on Channel Island and Caribbean trusts and provides expert reports for foreign courts, including those of the U.S.A. and France.
He is also an editor of Lewin on Trusts (19th ed., 2008; Third Supplement 2017) and has contributed chapters to A Practical Guide to the Transfer of Trusteeships (3rd ed., 2017) and Sham Transactions (2013). He sits in England as a deputy High Court judge.
